The Commission’s 2024 Rule of Law report

Valoramos positivamente que el texto reconozca avances relevantes en materia de Estado de Derecho. Celebramos, especialmente, el reconocimiento del derecho a la unión de personas del mismo género en el conjunto de la Unión Europea, lo que refuerza los principios de igualdad y no discriminación. Asimismo, es importante que el informe aborde la independencia de los medios de comunicación como elemento esencial en una democracia. Sin embargo, consideramos que se debe ir más allá: es fundamental garantizar la independencia real del poder judicial, reforzar los mecanismos de vigilancia y lucha contra la corrupción y denunciar, con claridad, prácticas como el control de los medios públicos por parte de los Gobiernos o la infiltración de policías en movimientos sociales. Nos hemos abstenido porque el informe contiene, además, una crítica genérica e injustificada a las leyes de amnistía y los procedimientos de indulto. Se trata de instrumentos plenamente legales en los sistemas democráticos, avalados por el ordenamiento jurídico español y por su Tribunal Constitucional, siempre que respeten los principios de legalidad y proporcionalidad. Cuestionarlos sin atender a su contexto concreto contribuye a estigmatizar herramientas que, en muchos casos, han permitido resolver conflictos y avanzar en la protección de derechos y libertades fundamentales.
